(IPID) welcomes today’s decision by the Randburg Magistrate Court the decision to dismiss Section 174 application to drop the assault case against Deputy President Paul Mashatile’s former bodyguards.
Shadrack Kojoana, Johannes Mampuru, Joseph Mofokeng, Harmans Madumetja, Phineas Boshielo, Churchill Mkhize, Lesibana Rambau, and Moses Tshidada brought an application for discharge in connection with an incident that allegedly occurred in 2023 near the William Nicol off-ramp on the N1 towards Pretoria.
The VIP Presidential Protection Unit officers were allegedly filmed assaulting off-duty trainee soldiers while pointing firearms at them on 2 July 2023.
The accused officers appeared in court today after their legal representative brought an application for discharge in terms of Section 174 of the Criminal Procedure Act.
The court ruled that all the accused will continue to face charges of malicious damage to property, and assault with intent to cause grievous bodily harm.
Additionally, Boshielo, Mkhize, and Tshidada face charges of pointing a firearm, while Mampuru and Rambau face additional charges of reckless and negligent driving.
The trial has been set down to continue from 23 to 27 March 2026.
