Three Policemen on trial for Chatsworth Assault GBH – Durban Regional Court
Three policemen are appearing in the Durban Regional Court (Court P) for assault with intent to cause grievous bodily harm (GBH) for trial – which was set down for 15 – 17 July 2013. The accussed Constable Yogandram Muninsami - Chatsworth Crime Prevention, Warrant Officer Jerry Abraham - Chatsworth Crime Prevention and Sergeant Aniel Dawlat - Marianhill POP, were arrested by the Independent Police Investigative Directorate following the appearance of video footage showing the assault which allegedly took place in December 2011. The victims were assaulted with broomsticks while the police wore balaclavas.
It is alleged that the 37 year old complainant had a quarrel with off-duty Constable Munsami at a fun fare in Chatsworth. After sometime the Constable went to the complainant's place of residence in Chatsworth, accompanied by his colleagues – all of them on duty. The complainant was with his two friends. The complainant and his friends were allegedly assaulted by the three accused with broomsticks and mops whilst lying on the ground. The assault was captured by a CCTV camera which was installed on the premises.
The matter was reported to the IPID, which conducted an investigation leading to the arrest of the accused.
The Director of Public Prosecutions (DPP) decided that the accused be charged with assault GBH and defeating the ends of justice.
