Police Constable sentenced to 33 years imprisonment for rape
The Independent Police Investigative Directorate (IPID) investigations secured a 33 years sentence against a South African Police Constable Lungile Israel Majola and his civilian accused on 25 June 2015 at Palm ridge High Court.
It is alleged that the 18 year complainant (who cannot be mentioned in order to protect her identity) and her boyfriend were walking along the road when a Red VW Polo vehicle stopped next to them with two occupants inside the car. According to the complainant the two occupants of Polo then pointed them with fire arms, rob them of their cell phones and a jacket and then forced them to the car but the two couple refused. The victim `s boyfriend managed to escape while the victim remained with the two speeding of to the bush where she was raped by the two men.
The IPID took up the investigation and the two men of which one is a Police Constable from Vosloorus Police Station where charged and found guilty on 4 counts of,
- Pointing of fire-arm
- Robbery with aggravating circumstances
- Kidnapping
- Rape
All charges together came out with an effective 33 years imprisonment. IPID arranged for the victim `s counselling.
The matter was set down for the 27 April 2015 and the accused decided that he wanted a new attorney.
The matter was then heard on the 25 June 2015. The policeman Constable and his civilian accused was sentenced to a total of thirty three (33) years’ imprisonment
