Police Constable had sexual intercourse with a minor knowing he was HIV positive
A 29 year old police Constable from Matsulu SAPS in Mpumalanga was found guilty and sentenced to 4 years imprisonment after having an unprotected sexual Intercourse with a minor, aged 15 at Matsulu, despite knowing that he is on ARV Medication. The victim got pregnant and gave birth to a baby boy on the 3rd August 2014.She became pregnant as a result of the sexual intercourse she had with the accused and the police officer was charged for statutory rape.
The family members of the victim filed withdrawal statement and in the interest of justice and of the victim, IPID opposed to the withdrawal of the case. It is alleged that the suspect knew of his HIV status when he engaged in intercourse with a minor. He was found guilty on the 25th of June 2015.In sentencing him, the Magistrate also indicated in the report that the alleged constable must be listed In terms of Act 32 of 2007 section 50(2) (a) the particulars of the accused must be included in the national register for sex offenders.
