Constable convicted for murder and other offences for Delmas shooting of EMPD Officer in Brakpan, Gauteng

Brakpan SAPS Constable Siviwe Ndyoki was today convicted by the Delmas High Court of murder, attempted murder, escaping from lawful custody and driving under the influence of liquor. The conviction follows an investigation by the Independent Police Investigative Directorate (IPID).

It is alleged that on 10 February 2013 at about 18:00, members of the Ekurhuleni Metro Police Department (EMPD) were called to attend a scene of a collision between two motor vehicles in Tsakane, Brakpan. It is alleged that on arrival at the accident scene, members of the EMPD tested both drivers for alcohol, using a breathalyzer device. It is alleged that the one driver tested negative whereas Constable Ndyoki, the other driver, tested positive and was above the legal limit for alcohol.

It is alleged that the members of the EMPD then placed the suspect under arrest for drunk driving and took him to Pholosong Hospital for blood samples to be taken. It is alleged that the suspect opened fire and shot the driver, Officer Poppie Maseko, who died later that day and that he further attempted to shoot at the front passenger but missed. The suspect was overpowered by another officer who was seated in the back seat with the suspect. He then ran away, he was captured later. It was found that the suspect was in fact a police Constable stationed at Brakpan SAPS, who was off duty at the time of the incident.

The case was remanded to 17 March 2015 for sentencing by North Gauteng High Court sitting in Delmas.
